Spanish Telemarketing Regulations: The New Code of Ethics for Consumer Protection

The Spanish government has implemented regulations to protect consumers from fraudulent activities and unwanted telemarketing calls. One of the most recent measures is the new Code of Ethics for telemarketing calls, which was introduced in 2021. The new code aims to improve transparency and protect the rights of consumers during telemarketing calls.

Under the new Code of Ethics, telemarketers are required to identify themselves, the company they represent, and the purpose of the call at the beginning of the conversation. Telemarketers must also provide consumers with clear and accurate information about the products or services they are promoting. If a consumer decides not to purchase a product or service, telemarketers must respect their decision and not use aggressive or misleading tactics to convince them otherwise.

The new Code of Ethics also includes regulations on the frequency of telemarketing calls. They must also respect a consumer's request not to receive further telemarketing calls.


The hours of commercial calls are restricted as of January 1, 2022, and cannot be made before 10:00 a.m. or after 9:00 p.m. Nor from 3:00 p.m. to 4:00 p.m. or on weekends.



In addition to the new Code of Ethics, the Spanish government has established a "Robinson List" that consumers can register for to avoid receiving telemarketing calls. Telemarketers are required to check the Robinson List before making any telemarketing calls to ensure that they are not calling a consumer who has registered to be on the list.

It is important to note that telemarketers must obtain prior consent from consumers before making any telemarketing calls. Consumers must also be provided with an easy and free way to opt out of receiving future telemarketing calls.

The new Code of Ethics and the Robinson List are significant steps towards protecting Spanish consumers from fraudulent activities and unwanted telemarketing calls. However, if a business wishes to make outbound calls to known contacts who have already given their consent to receive calls from the company, there is an alternative direct route available. This carrier is a premium route and will not accept call centre traffic. It is only suitable for manual calls to known contacts who have already given their consent to receive calls from the company.
